Legal Question in Family Law in Georgia
Unmarried Parents Rights for Custody
We are not married and I want to go home to Atlanta to be with my family and take my 8 month old son. What are my rights as his mother. His father is wanting to make this a war. So I need to know where I stand legally.

Re: Unmarried Parents Rights for Custody
As the father he has the right to visitation and the obligation to pay child support. Is he paying child support? To establish that he is the father either you or the father needs to file an action for Paternity. This action establishes that he is the father and a visitation schedule gets prepared and the child support amount is established.
