Legal Question in Family Law in Georgia
Wife takes Children out of State
I have been living with my ex-wife for 6 years. We have 3 more children after the divorce, making a total of 4.
She simply decided to move the children from our home in GA to the mother's residence in Missouri, vowing I am never going to see them again. We had no serious domestic problems other than minor disagreements over trivial issues. I am not violent and neither was I abusive. I have supported the family for the most part in the past 6 years, despite the fact that she worked and made good income as a registered nurse. I reported to the police, but it does not seem they are doing anything about it. They will not even return my call. Do I have any legal rights here that I can enforce?

Re: Wife takes Children out of State
You should definitely see an attorney soon. If the divorce was in Georgia, as long as you live in Georgia, then jurisdiction over custody and visitation generally remains here. As to the three post-divorce children, it sounds like you need to legitimate them and seek custodial and visitation rights. If they have recently left and no other order is in place, then Georgia would probably have jurisidiction over that action. Please let us know if we can be of further help.
