Legal Question in Medical Leave in Georgia
FMLA Denial
My employer has denied my request for FMLA to leave the state to assit my mother who is at the point where she needed to quit some of her cleaning jobs and is having problems from chronic backpain she is being treated for. Also, she has also been diagnosed with severe depression. My employer says our company has no leave that he will approve me for to let me assist my mother, as well as, due to the fact we are so 'short-handed' at work with paramedics, he will not approve any leave for me unless ''some fall out of the sky''. Her Dr. has agreed to sign the forms when I send them to him. I need to be out there for her but am hesitant to just up and go, although, I am considering giving my 2 week notice. At this point, what are my appropriate choices?
Thanks -R

Re: FMLA Denial
Depending on the size of your employer, it may come within the federal Family and Medical Leave Act. If it does, there are steps you must take to force your employer to give you leave.
You can either seek counsel with a lawyer regarding the federal laws or visit the Department of Labor's website. There is a detailed section on the agency's website on FMLA (www.dol.gov). If there are additional questions after you read the information, you may want to spend a few hundred dollars and an hour or two to consult with an employment attorney.
