Legal Question in Civil Litigation in Georgia
Hello. Thank you in advance for your time. I was being served by a Process Servicer and was not at home. One of my neighbors signed for the summons and never gave it to me. This was in July. I'm now finding out that a judgement has gone against me because I did not answer the summons. I have done some research and I believe I have to file a Motion To Set Aside Judgement. Is this correct? I do not have funds to have a Lawyer represent me. What do you suggest?
1 Answer from Attorneys
You didn't state how much the judgment was against you. In any event, depending on the amount at stake, You may not be able to afford to forgo retaining an attorney. In fact, filing a simply motion and appearing at hearing should not cost that much.
If you simply refuse to hire an attorney, you will have to research on your own. Fulton County Court law library has material that may assist you in filing a motion pro se. However, many people simply don't have the time or don't want to take the time to read the rules and codes and complete the necessary forms. In any event, time is of the essence.
