Condo Association Enforcing Covenants

Dispute on property line for constructing a fence. Fence has been put up beyond covenants- 2 townhome owners. Told to take down. Approximately 30% of owners have broken covenants in past and still out of compliance. If I can't construct fence shouldn't they have to comply to regs or should association change covenants?

I represent residential but not condo HOA associations and have been asked this question often. If the assn. has allowed others to violate the covenants it may be legally required to allow your fence. However, many more facts need to be developed. Contact a local attorney.
