Yes. Depending on the allegations in the case, after motions for dismissal and summary judgment are filed and reviewed, the employee may be the sole defendant left in the case.

The employer usually provides the attorney for the employee. So, you should talk with that attorney about the case. However, in certain instances, a conflict may occur, in which the employee will need his or her own attorney. Even in those instances, the employer or the employer's insurance company usually pays for the representation.
