Legal Question in Civil Litigation in Georgia

Handwritten ''legal'' form

My husband is being sued by his ex-fil. They went to mediation Tuesday. Yesterday he received a copy of a handwritten ''form'' stamped by the county's Municipal Court and ''signed'' with the judge's signature stamp with someone's initials written beside it. The form was written in the plaintiff's handwriting and the other handwriting on it looks like his daughters. The form was meant to inform my husband of the set court date but was sent by the plaintiff. Is this legal?

Re: Handwritten ''legal'' form

You should assume that anything you get from the Court (Clerk or Judge) is "legal." Obviously, we don't have a copy to respond further, and even then would not second guess something from the court.

This may be the way they handle things in that court. I would run this by a local attorney to make sure everything is OK.

Re: Handwritten ''legal'' form

I would call the court to verify the court date. It is not unusual for one party to draft an order of the court for the judge to sign.
