Legal Question in Civil Litigation in Georgia
Using Public Records to Slander
Someone accessed my public arrest record for 13 bad checks. This occurred more than 10 years ago and I was in college (18 yers old). I now own a very successful business, my husband is a police officer, and we have a daughter. This person is showing my arrest record to anyone and everyone, and is threatening to post it on a public internet message board. Is there anything I can do to stop this before it ruins my business, my life and my family?

First, to avoid this in the future, you need to look
into having your record expunged.
Second, why is this person doing this to you?
If he or she is threatening you because you won't do
something, it MAY be considered blackmail or extortion,
which MAY be a crime.
Third, you MAY have a civil claim against this person
if he or she carries through with the threat. You need
to obtain legal assistance for those issues. I CANNOT
assist, but I recommend obtaining a consultation with
an attorney if you are truly concerned about it coming
out. An attorney may be able to write a letter with to
this person before the harm is done.

I would like to know more facts, but based on what you have posted, you may well be able to combine an action for an injunction against future dissemination of the information with a lawsuit for invasion of privacy, intentional infliction of emotional distress and/or anything else that the facts my support. You should consult with a local attorney ASAP.
