Legal Question in Health Care Law in Georgia
Durable POA for Healthcare
Since Georgia code does not specify who can or cannot witness a DPOAHC and it does not have to be notarized, if I complete the Georgia statutory short form of the DPOAHC and have it witnessed by two of my immediate family members without a notary, will my document be legal and valid?

The best practice is to select witnesses who are unrelated and not after-death beneficiaries of any property that belongs to the the person granting the power-of- attorney. The witnesses should also be competent and at least 18 years of age.
