You should contact an immigration attorney who specializes in VAWA issues. If this law is applicable to you, you might be able to self-petition.
However, you should not file anything without a legal advice and assistance.

Greetings,
When you state you have been unable to file, I am assuming that you are referring to legal permanent residence.
Despite the fact that your husband has been in and out of jail, you still may able to obtain legal permanent residence. Your husband's situation does pose a few problems, such as your husband meeting monetary requirements for the affidavit of support and you obtaining various documentation from him, but you still may have options available.
I would suggest you contact an experience immigration attorney, and I would recommend Ms. Yenniffer Delgado. You can contact her at [email protected] or 404-939-5553.
