Legal Question in Employment Law in Georgia

Getting ''let go'' for something said on the first day of employment

I started working for a new Broker. I am still considered a self employed Real Estate Agent because I do not get an hourly pay. My first day of work, later in the day, I was in the office with two other co workers and we started talking about some people that two of us knew. That led to a conversation about the nightclub seen in our city and we talking about drinking, drugs and wild stuff. Not that I did drugs, just about people doing a lot of that in our city. The next work day, I was a little late getting to work (30 min) and I ended up getting sick a few hours later (vomiting numerous times) and having to leave. That night the Broker called me but since I was very ill I could not call back until the next day. Then I was told that it was not going to work out with me because of some of the things that I said on my first day. This was four days after the fact. I left my other broker to go work for this company and It is very time consuming to transfer all this over. Do I have any legal recourse? I feel that I was let go without given a chance, and after I quit my other job.

Do you have a written contract or an oral contract for a definite period of time?

If not, you are an employee at will (or independant contractor) and can be let go for any reason and at any time, even if it's a stupid reason and even if it's done on the first day of employment. There are limited exceptions to that rule, but based on the facts that you provided, it does not seem that you fall within those exceptions.

Unfortuantely, the Georgia legislature has decided not to protect employees and independent contractors from unreasonable or wrongful terminations.
