With hold a payroll check

My son was working with a company out of town. Which meant that they paid him a per diem of $75 a wk. He needed an advance to pay his rent. He signed an agreement to repay $160. A wk and that if he ''quit'' his last pay check would be held in lieu of debt owed. Today the ''employer'' terminated him and kept his check and said would kept the one for next week too. Since he was let go will the agreement stand and if so since it said the last check can they keep the last 2 checks and does per diem have anything to do with his salary?

The resolution is simple - deduct what he owes them from the amount he is due, and he is paid the rest. Both sides then move on with no further obligations. I am not sure why this is an issue, unless the goal is to get a paycheck and then skip out on the debt to the former employer.
