Legal Question in Employment Law in Georgia

Medical Leave lead to me being terminated from my job

Due to a high risk pregnancy I was placed on complete bed rest by my physician. Upon notifying my employer of this decision they sent me a notice of my employment termination in the mail. I had not been with the company for a full year yet and I just need to know if this legal.

You should obtain a copy of the types of leave that your employer offers. You may have received such information when you were hired. Some employers offer extended leaves of absence for emergencies experienced by individuals who are not covered by FMLA. Moreover, you may be covered by short term disability coverage, if your employer enrolled you that type of plan automatically or if you elected that coverage.

Your employer MAY have run afoul of among other things, Title VII, which protects against certain discrimination. I recommend you take advantage of free or low cost consultations provided by attorneys to discuss the matter.

You may also move forward on your own. The first step is to review the information on the EEOC's website to determine if your employer and your fact pattern falls under the jurisdiction of the agency. (www.EEOC.gov). If the employer falls under the agency's jurisdiction, you must file a charge if you want to pursue the matter further. Regardless of which course you choose, time is of the essence in all litigation matters.

I would be happy to discuss the matter with you in an initial telephone conference. My Georgia contact information is available on LawGuru.
