Legal Question in Employment Law in Georgia
Last Paycheck
My daughter was fired last week and when she went to pick up her paycheck today, she was told that she couldn't have it because she did not return a hat (which she thought was hers to keep), key card (which the company new was lost since March), and the employee manual (which she thought was in her desk). She was never informed that she would have to return any of these items. Who do we contact to help her get her check. This was her first real job and we don't know where to turn.

Re: Last Paycheck
First, she should return the cap by certified mail, return receipt with a letter stating that she is returning the cap and she does not have the employee manual, which is in her desk. Also, she should identify the person(s) whom she told about her lost key card.
At that point, she should give a date certain that she or someone on her behalf will pick up the check. If they refuse to provide the check, she should go to the U.S. Department of Labor to file a complaint regarding wage violations. If the Department cannot or won't assist, she can file a lawsuit in small claims court. Of course, she can bypass the Dept. of Labor and sue in court.
