Is it legal if an employee's salary is contigent to a 40 hour work week, to dock the employee's pay if there are no longere 40 hours available to any employee?

One usually starts with the proposition that absent a contract, an employee can be terminated for any or no reason (with very few exceptions related to discrimination). It follows they can reduce or change the pay scale, as long as it is above minimum wage. We can't figure out from your post whether you mean they are changing your salary after the fact, or going forward.
