Legal Question in Employment Law in Georgia
Unemployment/?age and wage discrimination
I am a physician assistant w/27 yrs experience and stellar record.I was laid off 8/24 and am receiving unemployment due to ''lack of work'' this week my former employer placed an add for a physician assistant with ''no experience required''. The only differnce was that I was working outpatient (clinic) but this position is inpatient. However, I did have inpatient privledges and in fact did admission on my patients(not required of another midlevel provider in the same office who does similar work). I feel I was removed due to my age/experience and higher salary. Does this constitute a claim to EEOC? I am age 50 and had an 85k/yr salary, New grads can be hired at a lower salary.

Re: Unemployment/?age and wage discrimination
If they hired a younger person for the exact same job, you would have a somewhat stronger case for age discrimination. Also, if you applied for the position and you were not given it because of your age, you would have a strong case.
Nevertheless, you should go on the EEOC's website and read the information it supplies to the public. After reading the information and possibly taking advantage of free or low consultations with attorneys, you may want to file the charge with the EEOC. You don't need an attorney to file a charge and you may be able to take advantage of the mediation process.
