Legal Question in Employment Law in Georgia
We work for a florist in Georgia, that has been deducting 15minutes from our time each day for lunch even though we continued to perform our job duties while trying to eat. Is this legal? How is back pay calculated. Some employees are PT and one is FT. We have contacted the DOL Wage and Division but we are getting different answers from different employees.

I understand you want to be paid for work done, but many employers (for reasons that are usually obvious), do not want employees working while they are eating. The employer probably should make the rule clear if that is why they are deducting the time. If you push the issue, they probably will do just that. You should have discussed this with the employer, but you fail to tell us what was said. The employer's interest is that it is hard to eat lunch and give total attention to the work. The ultimate solution going forward is probably going to be that you clock out during your lunch and breaks, and clock in when you are finished and ready to work.
