Lease Purhcase Agreement

my lessee is suing me in superior court over repairs he has made the past 5 years under a lease purchase agreement. I recently won a judgement in magistrate court to have him evicted and I didn't have to pay him any of his allegations. my question is, i want to submit a motion to dismiss and answer his claim. is there any chance that this frivolous suit can be thrown out before it ever goes to court?

It seems like you would have a good chance of having the suit dismissed under the principles of res judicata and/or collateral estoppel due to the previous suit in magistrate court. Have a local landlord-tenant attorney review the current and previous suits and relevant facts to determine how best to respond to the current law suit.
