Legal Question in Landlord & Tenant Law in Georgia

My sister and her boyfriend applied for an apartment he was denied due to a child endangerment charge on his record for an unfortunate incident that occurred when he was a new father. She was told that she could apply by herself and made a deposit to hold the apartment. The next day she was contacted by the property manager and told that I could not reapply at all and could not be consider for an apartment on my own. What are my rights?

My sister an I had both made a down payment for separate apts., when they attempted to give my sister back her check that gave her mine instead. Then they made a fuss about her residing in my apt. where I am the lease holder without being on the lease. However, when applying for the lease I was told by the office attendant to leave her off since I would carry all the financial responsibilities. To top it all off the property manager was very rude, and there are several complaints about her on the internet. What are my rights and can I take any legal action regarding the neglect they showed in returning the check or her attitude?

Obviously few if any apartments will allow a person with a criminal record to live there, so your sister and her boyfriend can expect to be turned down in manyplaces.

Obviously you have no legal case at all for your incident. You don't get a lottery win just because a clerk is rude or makes a mistake. If you make a big deal about it, you can also expect they won't renew your lease when it's up. Regardless, you have no case.

Of course you cannot "take legal action" because of her attitude or being rude. What if she thought the same about you and sued you for not being nice? Neither you nor your sister have a right or entitlement to any apartment (other than pursuant to a signed contract) or that people will not be rude to you.
