Legal Question in Personal Injury in Georgia
I am 33 yrs old and cant seem to quit smoking. I started smoking when I was 11. At this time the cigarette companies were advertising in cartoons and other such methods to get the attention of minors. There was not a legal age to by cigarettes. As of now I have chronic broncitis, which is the beginning of C.O.P.D. I am on inhalers and Bronchitis controllers. Can I sue the tabacco companies for directing their advertisements at minors, health complications, and the fact that I am addicted and cant seem to stop smoking due to the addictive nature of nicotine? That the cigarette companies where aware of the addictive propertiesof nicotine? What legal standing do I have and what is the possibility of a success in the court room? I have had a collapsed lung in the past and fear that I may be in extreme danger of deadly illnesses.

Sure you can sue, but tobacco companies have a very, very good track record for cases that involve advertisements well before the warnings were added. Such warnings were added (and TV advertising ceased) well before you started smoking, or were even born. You can certainly seek out lawyers on the internet who handles these cases. However, none of that will help you stop smoking. It will give you someone at which to point a finger. It is your decision to keep smoking - the same with any addiction (drugs, tobacco, food, etc.). Sure you are extreme danger of more serious health problems, but you are the only person who can decide to make it worse, or make it better.
Your claim is a very difficult one due to your age, and chronic addiction. Most successful cases have been won by smokers who did not have the benefit of warnings placed on cigarette packages.
