Amount to ask for in an insurance settlement

What is a fair dollar amount for pain & suffering r/t a bodily injury claim? I was crossing the area in front of Wal-mart which is yellow lined for pedestrians to use when the driver of as SUV steered into me knocking me down. That was on December 08,2006. I continue to have headaches & dizziness, which seem to be improving. I would like to submit an amount for personal injury as well as pain & suffering, but have no idea what to ask for above the amount of the medical bills.

There is no set amount for pain and suffering in a personal injury case. Even in your case, if three people had the same accident, their individual situation would warrant different amounts for pain, suffering, loss wages, future medical bills, etc.

If you have an attorney, you should discuss the matter with him or her. Your attorney knows the facts about your case more than anyone on this board.

Second, if you have headaches & dizziness, you may want to seek legal and medical advice before settling on an amount that is less than what you are entitled.

In GA, the legal test is "what the enlightened conscience of a fair and impartial jury" decides is appropriate in each case. Thus, there is no set forumula or table to refer you to. Consult with a local attorney.
