Legal Question in Personal Injury in Georgia

I was in a car accident 4 months ago. I was re-ended on the highway causing damage to the back of my car and totaling out the other persons car. We both have the same insurance company, thus damages to my car were paid for and some of my medical bills have been paid. I spent 3 1/2 months at a chiropractor to help with the excruiating back pain I was experiencing and still am experiencing. I've also tried physicial therapy. All of the doctors I visit tell me to just try certain exercises to relieve the pain because this is something I will be dealing with for the rest of my life. My Question is, do I wait for the insurance company to provide a settlement or do I prepare to sue?? With the profession I am going into, I will be experiencing long term pain. Please help

Unless you want to hurt your potential legal claim, do not discuss the case at all with your insurer. Get a lawyer. You are very possibly entitled to not just your medical bills but pain and suffering and other damages (if there is long term damage).

If you try to sue yourself, you will probably lose, as suits are complex (and indeed most cases with lawyers settle without suits). Also, if you wait for a settlement, insurers won't do anything without being pushed.

Your case is not ready for settlement or a lawsuit at this time. You really should continue treatment to get better and not worry about a lawsuit now. Your frustration is understandable. You were not at fault and are now burdened with medical problems. We need to find out more from your doctors on what if any improvement you will make and what medical options are available to you. You should consult with an attorney that specializes in personal injury as there are a lot of insurance and medical issues that will come up.
