Legal Question in Personal Injury in Georgia

I was in a fender bender and the other party was at fault. The insurance on the car they were driving wasn't in the name of the person who was driving. I spoke with their insurance company and they took my statement, and sent out an appraiser. This happened over a month ago but they say they can't proceed any further until they get a statement from the other party. However, the other party isn't responding to their insurance companies phone calls or letters. I'm sick of waiting, what do I do? This is the second time I have been involved in a fender bender due to no fault of my own. The first time I filed a suit against the person because their insurance company wouldn't pay me. I won but she still never paid me my money. I am determined to get my money this time. What do I do?

If it's property damage only, sue the driver in small claims court. Make sure you mail a copy of the suit to the insurer.

Or turn it over to your own insurer if you have full coverage.

If there were injuries, hire a lawyer.
