Incompetent Judge

Two Part Question:

1. Are the proceedings of divorce mediation a matter of public record?

2. If not, is it libelous if a published editorial criticizes a publically elected judge for his actions in regards to such mediation provided the names of the participants are not disclosed?

1. Not that anyone can look up, such as lawsuits. However, there usually is no gag order preventing anyone who was present from talking.

2. I am confused by this. Judges ordinarily do not take action regarding mediation, unless a settlement was reached, in which case the judge would direct the parties to prepare an order incorporating the terms of the agreement, or the judge may just ask for the terms and prepare his/her own order.
