Legal Question in Personal Injury in Georgia
What is the maximum amount a person can receive from a predestian accident crossing the street in the cross walk with the correct light for the predestian. I received a broken foot, was in a cast from 5/16/11 to 10/3/11 I had complications with healing. The insurance company made me an offer of $12,400 this is including my medical expense which they calculated as $3400. What should I ask for, I don't feel this is sufficient. The doctor released me but I'm not back 100%, plus I'm a diabetic and don't want to have to deal with problems later.

There is no way to give you a firm answer, and you should not be relying (again) on the internet to answer you. No one here knows anything about the accident, how much your bills actually are, and so on. There is no magical number you seem to want to hear. Either get a lawyer (and plan on giving up 30 or more percent to the lawyer) or keep going on what you "feel" is sufficient.
Clearly, you are deeply concerned with the fairness of the insurance company's minimal offer because you have made two postings on this website board. You should follow that instinct and realize that this is not a time to fight alone. You need assistance to avoid making an uniformed decision that you may deeply regret. There is far too much at stake for you to not speak with an attorney to gain sound advise from a professional that will fight to ensure that you receive all the compensation that you deserve- not just the minimal settlement currently being offered.
It is important that you now immediately contact an attorney to begin handling your claim with the insurance company. I can help. Call my office today for a free telephone consultation. (404) 496-4119.

The best way to get underpaid in any accident is to talk direct to the insurer. Study after study shows that insurers offer far less to pro se litigants that represented ones. Study after study also shows that cases are damaged by statements you make to insurers before hiring counsel.
So while no one can say what you should get without a review of the medical records and other information, it is safe to say that the worst way to have handled it until now was for you to have talked to the insurer at all, and to do it without counsel.
My office would be glad to do a free consultation to assess your case and determine what should be done. 404-768-3509. Whatever you do, get a lawyer and stop talking to the insurer. Be aware there are strict time limits on your claim.
There is no set amount that can be recommended here. Settlement numbers can change very drastic depending on the case details and attorney negotiating skills, but clearly $12,400 settlement offer for a broken foot does not seem just. We also need to evaluate loss of earnings and of pocket expenses if any. I strongly recommend that you do not try and negotiate your own case and seek help from a good personal injury attorney that can negotiate your claim in light of a just and fruitful settlement. And it is also very important that you continue to seek medical treatment if you are still suffering injuries from the accident.
