Rear Ended but other party said I came over on them

I was involved in an accident and hit dead center rearend. The other vehicle came out of nowhere and hit me, but claim I came over on him. The police gave him a ticket for hitting me in the rear but said since he wasn't there and other driver said I came over on him, he had to give me a citation for improper lane change. I didn't get a chance to change lanes because the other driver hit me so hard that my car spun around facing oncoming traffic. I was hit dead center rearend. What can I do since I sustained injuries to my lower back, upper back and neck. I had to be transported by ambulance to the hospital.

"At fault" drivers lie all the time. Hire an attorney. He/she may advise you about the advisability of spending $$$ for an accident reconstruction expert.

Just because the bad guy is lying don't give up. First, under no circumstances should you plead guilty to improper lane change or any other charge. That could be used against you in court. Hire a good P.I. lawyer, there are ways to prove how a collision occurred- accident reconstruction etc.-and make a claim. If you are in the right you will prevail.

In GA, Driver 1 is typically considered the "at-fault" driver on the MVA Report. In addition, and as you likely know, the driver who causes a rear end collision to another is often deemed liable for the property and/or personal injury damages. The fact that you were cited as well does not help your case, but it is not necessarily detrimental. I advise contacting a personal injury attorney (who routinely handles auto accidents) in your city.
