Legal Question in Personal Injury in Georgia

I am a waitress at a restruant and bar...Three men came in one was a professional football player his manager and bodyguard...I was not their waitress the football player grabbed me by my arms several times and rubbed his penis on me..he grabbed me so hard my arm immediately started to bruise. I told him I was not interested to please leave me alone. Another waitress asked him to leave. The three of them were obviously looking for trouble. I was taking someones order when the football player punched me in the face. The three men attacked me and the waitress who tried to help me, another patron and our 60 something year old manager. The police came and arrested them. They took our statements. Do I have any legal recourse.. against the three men or the bar and grill owners because they are telling me they do not want me to press charges. They want this to go away.

The police generally will press charges in this type of incident. You could be entitled to workers compensation from your employer for medicals and lost wages and you can bring a lawsuit against those who struck you.

You do have legal recourse against the three men and possibly the bar owners as well.

You have taken a first step by posting on this website. At this point, you should consult an attorney immediately, but do not post any other details on this (or any other) public website.

You are entitled to several things: First, since this happened on the job you get all your medical bills paid by the Workers' Compensation insurer covering your employer. Second, if you miss work because of your injuries more than just a minimal amount of time you get weekly WC payments to make up for your lost wages. Third, you have a legal claim against the people who struck you and touched you improperly. You should NOT try to do this yourself no matter what other people are saying. Get the toughest lawyer in your area to represent you ASAP. If you don't know who to get call me at (770)427-8468 and I will refer you to the right attorney in your area.

You do have a claim for battery against the 3 men. A civil claim against your employer is likely barred by Worker's Compensation laws. What that means is that you can get compensation from your employer's worker's compensation insurance carrier, but not additional compensation in a civil suit against your employer.

I would be happy to schedule a free consultation with you regarding your claims against the 3 men if you have not already retained counsel.
