If the seller of a home does not meet the terms of the contract (specifically in our case, the home is not in the same condition as it was at time of contract and a service they agreed to have performed was not done) by the settlement date, can we legally terminate the contract and get our earnest money back?

The wording of the contract will determine your rights. Consult with a local attorney. The contract and all the circumstances need to be investigated.
