Legal Question in Real Estate Law in Georgia
Georgia real estate law
If the seller of a home does not meet the terms of the contract (specifically in our case, the home is not in the same condition as it was at time of contract and a service they agreed to have performed was not done) by the settlement date, can we legally terminate the contract and get our earnest money back?

An attorney would need to examine your contract in order to answer your question. I have experience handling matters like yours. Feel free to ask my firm to assit you if you are not already working with an attorney.

The wording of the contract will determine your rights. Consult with a local attorney. The contract and all the circumstances need to be investigated.
