Legal Question in Real Estate Law in Georgia
Hoa wants $4000.00 threatening a lien
I just recieved a notice that the HOA believes I owe $4000 in back dues, interest and fees. I purchased a house in 2002 was told that I was not a part of the association and was turned away from facilities. There is no mention of dues in my closing documents, I have not been billed, and signage shows I am not in subdivision though legal description says I am. Where do I start to fight this?

Your best option will be to consult with an attorney who is familiar with HOA and real property law. My firm does this type of work and knows what steps to get to the bottom of it. Feel free to call upon us in the event that you do not have another attorney that you wish to employ.

Your best first option is probably not to pay a lawyer for a $4000 claim, though obviously many will take a fee for starting the process if you want to do that. It is contacting the HOA to discuss the basis for their claim. If you need to retain a lawyer, get referrals for a local lawyer who actually primarily practices in this area of law.
