Legal Question in Sexual Harassment in Georgia

sexual harassment statute limitations

I think that I may have a sexual harassment/misconduct case against my former boss. I was fired 8 months ago from that job. What is the time statute of limitations for filing such a case? --

Re: sexual harassment statute limitations

Under Title VII of the Civil Rights Act of 1964, as amended, under which sexual harassment falls, a claim of harassment must be made within 180 days of the last discriminatory (harassing) act. In some places in Georgia, there may be local deferral agencies where the statute of limitations may be 300 days. (There are also a number of states having deferral agencies where the statute is 300 days.) There have been situations where really egregious harassment occurred in which claimants have been able to make claims of intentional infliction of emotional distress, negligent hiring, supervision and retention under state law. In Georgia, the statute on those claims is two years. You will probably want to speak with an attorney to see if you live in a deferral area or if you can make claims under state law. Good luck!
