Legal Question in Sexual Harassment in Georgia

sexual harassment statutes

What is the statute of limitation for filing a sexual harassment suite in the stat of Georgia?

Also, can there be a law suite if I returned phone calls to him and also made calls to him when we were not at the office? What if I was being friendly in return to his advances? Or if I quit because of an unrelated incident, but really I was getting tired of his advances?

Re: sexual harassment statutes

If you are referring to Title VII of the federal, law and your employer is a private employer, your first step is to file a claim with the EEOC. So, you understand all the issues in filing a claim, I direct you to the EEOC's website (www.EEOC.gov.) The site has good information on what qualifies as sexual harassment and how to file what is called a charge against your employer for sexual harassment.

Keep in mind you have a very short time to file a charge, so be careful. The information regarding deadlines and companies that fall under Title VII is on the website.

You don't need an attorney to file a charge with the EEOC. However, you may want to consult with one (in person, on the phone, or by e-mail) to provide greater details about the facts in your case.

To all of your remaining questions, the answer is it depends whether the fact pattern still qualifies as sexual harassment as it has been interpreted by the federal courts.

This response does not create an attorney-client relationship. If you want further information about your potential claim you can contact me. I am also licensed to practice in Georgia.
