Legal Question in Sexual Harassment in Georgia

Sexual harassment

As a victim of sexual harassment, under my employees sexual harassment policy, how soon can they investigate a report of sexual harassment? And will they have a hearing between the victim and the harasser in the same room to hear both sides of the story to reach a conclusion to the matter(the harasser denied the charge)?

Re: Sexual harassment

A great deal depends on your employer's policy and practice. Courts have said that an employer should take "prompt remedial action" regarding complaints of sexual harassment, and employers differ somewhat in how they accomplish this task. It is clear that any investigation should be prompt, but it is unclear how prompt such an investigation must be. If you feel that your complaint is not being handled in a timely fashion, you might want to speak with the human resources manager or other person involved in the investigation. As to your second question, I doubt that the investigation will include a face-to-face meeting between you and the alleged harasser, although there is nothing that legally prohibits such a meeting. Again, I would recommend that you speak with the person handling the investigation to see how they plan to proceed.
