Legal Question in Wills and Trusts in Georgia

death,life insurance

My boyfriend's mom passed away, his sister handled all of the arrangements(funeral&burial),and had planned on paying for it with the life insurance($25,000).Now,wejust found out that my boyfriend is the 1st beneficiary named on the policy, and his sister says the funeral home is holding the death certificate until the bill is taken care of.Can they hold a death certificate? The insurance lady says she can't send out the check without the death certificate,so I don't understand how the funeral home can hold it.And how could my sister have made all the arrangements without my signature on anything?

It sounds like you have unwittingly gotten into a web of everybody else blaming everybody else. Consult with a local attorney ASAP. There may be some penalties against the parties involved.

The story goes from being about your boyfriend, to being about you in the last sentence. You may have a couple options - one person can get a lawyer and perhaps appear in war mode, which may cause damage in the relationships for a long time AND eat up more money in fees. An altenrative is to get togegher, discuss the expenses that need to be paid, and work it out.
