My husband has died and I can't find the will. Where do I go to get a copy?

The lawyer who prepared the Will should have a copy and may even have the original. Try to contact all the lawyers used by your husband.
Sometimes, but not often, a Will is deposited with the Surrogate for safekeeping.
Maybe he left it with the children or a close friend.
If the Will was last in his possession and cannot be found, the law assumes that he revoked it. First, a prior Will would take effect and if there is none, then the laws of intestacy would apply.

Who drafted the will for your husband? Don't assume that everyone (even those who say they do) has a will. In fact, most people don't. If you are unable to locate it, you still have rights. If you need further assistance you can contact my office at 212-208-2470.
