Legal Question in Wills and Trusts in Georgia
Who are the legal beneficiaries here?
My aunt recently passed away. Her husband predeceased her & they had 0 children. In her will, she disignates 1/3 of her estate to her sister-in-law. The sister-in-law died quite a few years back, was never married & had 0 children. My aunt's Will states exactly ''share & share alike, or to their issue or issues, per stirpes & not per capita.'' The sister-in-law did have some brothers, who are also deceased...but have chidren still living (4 total). Per how the Will states...do I go to those children and divide the disignated 1/3 share by 4? Are they legal beneficiaries? How do I handle this?

Re: Who are the legal beneficiaries here?
The sister in law's share goes into the residuary portion of your aunt's estate. The brothers have nothing to do with it. Having said that, I would advise you to consult with a local attorney to review the entire will.
