Legal Question in Wills and Trusts in Georgia

Power of Attorney-wills

I was Power of Attorney over my Aunt she was in her 70~s-(she had had a stroke) my nephew moved in with her and took advantage of her and her money. she left him a will while I was still POA Would this will be legal? I wasnt there when this took place. Is it ethical for a lawyer to just take a senior citizens word here as he was the only one named in the will here. He waited four years to probate the Will and done so only then because he stands to inherite a lot of money from a lawsuit from land that belonged to her Mother. Please answer Thanks

Re: Power of Attorney-wills

This is too complicated to explain in this type of format, so you should consult with a local attorney. Since you had POA when the nephew moved in, you should have moved all her assets into a separate account over which you had control. As to the will, if she were lucid, she could still execute a valid will. As I said, you should consult with a local attorney, especially as to the other questions you have.
