Mistaken title sent

I refinanced a 32,000 dollar LQ horse trailer to get another persons name of the title and loan. The DMV sent out a title to the person I removed from the loan without a lien holder. He since has taken the horse trailer and stuck me with the loan. What can I do since the bank has admitted to the mistake and asked him to return the title but yet has not returned it. I need desperate help. The bank is killinkg my credit because I refuse to pay the loan cause some else has the title free and clear. HELP ASAP!!!! PLEASE!!!!

Definitely consult a lawyer to clean up the title issue. If the title should have had a lien holder on it, but didn't you may have a chance at getting things straightened out. You might have to take this to court, in order to correct the title. Ask an attorney about unjust enrichment, but it seems to be a title action between you, the bank and the person holding the property PLUS the finance company.
