Role that Executors should play

My father died August 2003, he named his step son as executor. As my father lie in the hospital for the last 24 hours of his life, the executor gave away items that were precious to myself and my sisters. Recently I requested a written accounting of the estate, which is due to be closed soon, but was told my the estate lawyer that the executor would send it to me. My question is, shouldn't the attorney be supplying the accounting, and not the executor. Because who is to say that executor hasn't fudged some of the numbers. Doesn't the accounting have to be filed with the state? Also, can the executor sell real property before the will is read and he is named executor?

I recently received a Receipt and release and consent to closing, the real property as well as mobile homes, personal effects, bank accounts, etc have all been listed as if they were still available. This is not sold, and still in the estate. But when we ask for them, the executor says there is nothing left!! My sisters and I think that something is not right with this whole. Thing, the Executor seems to be pocketing the money and the lawyer is going along with it. Please Help ASAP!!

Contact an experienced attorney in the county where the estate is being administered.
