can an insurance company ask for phone records when investigatin a claim

They can ask for them but they have no legal right to them. You should never turn over things like your phone records, other records, or provide recorded statements to an insurance adjuster without first having consulted with counsel. Insurance adjusters consult with many attorneys (I know this because I was once one of those attorneys) and they look for "traps" to lead you into that will justify denying your claim.
