Legal Question in Bankruptcy in Illinois

court case

I have a bank credit card that i fell behind on they got a judgement against me and now i have a court date next month for citation to discover assets and i went to see an a attorney to see what my options are and he said i should file bankruptcy but he wants all of his fees paid upfront before we can begain i dont have that kind of money right now I asked him about the court date for next month and he told me Not to show up to the court date cause we are going to file a bankruptcy soon i hope what will happen if i dont go? do you know if there are any attorneys that would do a payment plan for the bankruptcy I am in a big bind right now.

If you do not show up to the Citation to Discover Assets, a Rule to Show Cause will be issued. If you do not show up for that, a Body Attachment/Warrant can be issued due to your failure to appear. If you file bankruptcy prior to the citation, then the citation should be dismissed.

I personally do not know of any attorneys that accept payment plans for chapter 7 bankruptcy (I assume you wouldn't be filing for chapter 13 but I do not know your entire financial situation). The reason they require payment up front is because that is how they get paid. You may want to contact prairie state legal services and see if they can find someone willing to do it on a pro bono basis (last I checked they do not do bankruptcy).
