Legal Question in Bankruptcy in Illinois
il chapter 7 discharge with lawyer equity in house now trustee wants money for it says we have to pay $350 for an appraisal, sent letter saying wants $10,000 or will sell house. Manufactured home value was 63.000. Married with disabled grandson also living with them. Was discharged 11 months ago. Shouldn't the bankruptcy lawyer take care of this, all he did was forward letter from trustee for money. Thought this was all taken care of since thats what we paid the bankruptcy lawyer for. Any recourse?

Thank you for your question. This is somewhat confusing to me as you state that you already received your discharge? That would entail the Trustee having determined there are no assets to liquidate? Generally speaking, a mobile (not manufactured) home is not considered a "home" within the traditional sense. A manufactured home is considered a "home" and one can apply their $15k exemption (per owner) towards it. Thus, the big question is whether you have some type of mortgage on it? And is it really worth $63k? In short, if you already received your discharge there should not have been an issue with your trustee.
