Consultant No-Compete Agreement

I recently signed a no-compete agreement with a consulting firm stating that I would not seek employment from any other firm with a select 6 companies within the next 90 days. I then informed the original firm that I had decided to stay at home with my son for a while. Due to recent developments, I have started seeking employment again, and another firm wants to recommend me for a position with one of the 6 firms previously referenced. Since I am no longer interacting with the first firm, and I was never actually employed with them, does the no-compete agreement still apply? If so, what kind of repercussions could I face if I went against the agreement?

Thank you for your question. By law, non-compete agreements have to be very reasonable in terms of scope of employment and geography. Thus, such agreements must be well written and often times are declared invalid. I would have to see the language, but it at least appears that they tried to limit the agreement in some manner.

Why did you sign the agreement in the first place - as you state you weren't employed by them?? Am I understanding you correctly?
