I just started my own company as a language services company and I am in the middle of landing my first contract. My brother is a self-employed interpreter as well and as he got contracted out for a job through another company, the company he was on site with offered to him work for them. After this las company reviewed their contract found out that they cannot hire him directly or they would be fined. Can my company get hired by this company and I then sub-contract my brother to do the job without getting into trouble?

You and your brother need to review the documents he signed with the first company. He may have signed a some sort of non-compete agreement with them, which would preclude him from contracting with the same company through your company. Most companies that supply contact employees have some sort of agreement with their contractors that precludes the contractors from accepting employment with a company with which the contractor was placed, at least for a certain amount of time.
