Legal Question in Business Law in Illinois

False Advertisement

I bought a bar from a couple that just reopened a bar 1/2 block down the street from me a few months ago. They've owned the bar for a few years. I have to pay rent to these people and have a contract to finish paying for the business. I was celebrating 1st yr. anniversary & grand opening a couple of weeks ago. That same day and that day only they advertised in front of that bar that it was under new ownership and also sold beer for $.50 which is way under cost . It was obvious they doing this to hurt our business and they even mentioned it to people. I know they are out to run us out of business,we are in debt to them and they keep doing these type of things. Is there anything we can do?

Re: False Advertisement

To be sure, you purchased the bar on an installment basis. That is, you are paying them over time, correct. They took it upon themselves to advertise in front of the bar without your knowledge/consent. Do they work in the bar?

Without knowing a little more, I cannot say with certainty. But, I would say that you have a myriad of potential civil claims against them. Breach of Contract, Interference with Business Expectancy, and maybe Fraud to name a few. However, the issue becomes whether you have been damaged to a point where it is significant enough to file a lawsuit.

I would be quite interested in hearing more and can likely give you some more direction with the answers to my questions above. Please feel free to contact me directly if you prefer. My email is: [email protected]

Thanks.
