Re: Default Judgment

It depends. The simplest way is to garnish a bank account. If you know of a bank account that the defendant has, you can present a proper garnishment writ, and the bank must honor it. Otherwise it may be exceedingly difficult to get your money. There are other ways such as a sherriff's sale of their assets, but this must be done by an attorney.

Good luck!

Re: Default Judgment

You haul the defendant back into court, and ask him questions under oath concerning his income and assets. You can require him to come to court by serving a citation to discover assets on him. The service of the citation will create a lien in most of his property, other than real estate. If he fails to appear and answer your questions, after being ordered by the court to do so, the court can order the defendant arrested, and set his bond, repeatedly until he either answers your questions on the sum of his various bonds posted to get out of jail is sufficient to pay off the judgment.
