Legal Question in Construction Law in Illinois

Owner's Rights after Occupancy of a New Construction

What are the owner's rights to having repairs completed to a newly constructed home by the builder in a timely manner? What constitutes a timely manner? We built a home, submitted the repairs in writting, followed up regulary for 5 months and the builder has not repaired.

Re: Owner's Rights after Occupancy of a New Construction

You have significant rights. I hope that you still owe the builder money. To retain money is the best way to have him perform. In Illinois as with most jurisdictions, you have a year's warranty on your home. As long as you are within this year window. You have executable rights. I don't know where you are located in Illinois, I suggest you call the builder again and request that he perform the remedial repairs. If he doesn't, then its time to see a lawyer in your area to consider substitute performance and/or other remedy.

Good Luck!!
