Legal Question in Credit and Debt Law in Illinois
I am collecting Social Security benefits. I owe about 2,000.00 on a car loan and the the car was repossesed. Can they sue me for the loan?

I think you're question is whether they can garnish your benefits when they come after you for a deficiency on the loan. No as long as you've kept the benefits you receive in a separate account and do not mix it up with other monies. If this is not your question, please restate it.

yes they can sue you but generally, ss benefits cannot be garnished, if the creditor is successful in their suit against you. please be aware that before the car can be repossessed, the credit has to follow certain procedures. if not, you can have a cause of action agains the creditor. to discuss further, call me at 312-372-5600.
