Legal Question in Credit and Debt Law in Illinois

Hello there,

I am being sued by a debt collector over a debt that is about 6 yrs old. I found conflicting information on the statute of limitation for IL, however, most sites stated that it is 5 yrs. (This is regarding credit card debt.) I also received a mailing stating an order has been entered against me regarding this debt. A friend informed not to make any payments on this debt because that will start the clock over...? Is that true and what is the statute of limitation for IL? Also, how does the order entered change thing if at all?

Thank you.

The only order is a court order. The statute of limitations for a contract is 10 years. See http://www.illinoislegalaid.org/index.cfm?fuseaction=home.dsp_content&contentid=7744 for an excellent explanation.

I agree with the previous response but I would add that until the court order is changed, you bound by it. You need to verify if a court entered an order. Call me at 312-372-5600 to discuss further.
