Legal Question in Criminal Law in Illinois
In 2008 I pled guilty to a charge of theft. All of the financial restitution amount fell under the Statute of Limitations however I agreed to pay it back. It has been almost three years and I am still unemployed, it is becoming impossible to pay the restitution payment. My question is can the restitution be set aside because I can't pay it.

I am assuming that the restitution is part of your plea agreement.
That being said, your payment of said restitution is part of the "deal" you received.
You will want to go back into court and speak to the judge regarding any changes/modifications.
