Legal Question in Criminal Law in Illinois

10 years ago when I was 19 I was arrested and charged with under age drinking, resisting arrest which was dissmissed, aggravated battery of a peace officer which was reduced to a misdemeanor, and misdemeanor battery. Which I was not guilty for any of the violent crimes but it was in a small town so it was the law enforcements word against mine I did get a lawyer which did not do much at all. That was the only time in my life I was ever in trouble with the law besides later in life with sppeding tickets. I went on to go to college have kids and get a career which I work as an occupational therapist assistant non of this from my past has ever come up I kind of forgot about it all and now I am in the process of starting a new job and moving to Texas and all of this is starting to resurface with my place of employment and housing. My question is is there any way to get this all expunged or sealed? Thank you so much for taking the time to answer my question.

Hi Shauna,

Whether you can get your matters sealed or expunged will depend on how your case was resolved (plea of guilty, supervision, conditional discharge, probation, etc.) and what charges you were convicted of and what charges were dismissed. Enough time has passed so that you qualify to have your cases expunged or sealed but it will depend on the what the outcome of your case was and what charges you plead or were found guilty of. I would need more details to give you a more definitive answer.

shauna, unfortunately the battery conviction prevents you from having your record sealed or expunged by the courts. you have to seek executive clemency. if the governor grants your clemency petition, you can then seek to have your record expunged. if you have further questions, i can be reached at 312-372-5600.
